❓ Frequently Asked Questions (Housing & Property)
Do I have to leave on the date written on my Section 21 notice?
No. Under the Protection from Eviction Act 1977, a Section 21 notice merely gives notice that the landlord intends to seek possession. Only a County Court bailiff acting under a warrant of possession can lawfully evict you.
Does an unprotected deposit make a Section 21 notice invalid?
Yes. Under Section 215 of the Housing Act 2004, a landlord cannot serve a valid Section 21 notice if the tenancy deposit was not protected within 30 days unless they first return the deposit in full to the tenant.
